The EB-5 Reform and Integrity Act 2022 allows EB-5 applicants who live in the US with a current valid visa to apply for file for Concurrent Adjustment of Status, being able to remain in the United States and obtain an Employment Authorization Document (EAD). This means that H-1B visa holders can apply for a work permit, allowing them more freedom to look for the best work opportunity and not necessarily rely on employer sponsorship.  

What is the EB-5 visa? 

The EB-5 Immigrant Investor Program is a US federal program that allows qualified investors and their immediate families to obtain permanent residency by making an investment in the US that creates jobs. By investing $800,000 over 5-7 years, applicants can ask for a work permit while waiting for their conditional green cards (on average, within 24 to 36 months of the EB-5 visa application).
